Terms of Service

1. Overview

These Terms of Service ("Terms") govern your use of Risk the Fog: Idle Expedition ("the App"), a mobile game developed and published by Benum Labs AS ("we", "us", or "our") for Android and iOS.

By downloading, installing, or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

The App is a game of skill and chance within a fictional setting. Push-your-luck expedition mechanics are gameplay elements — not real-money gambling. You cannot win or lose real money through gameplay.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App. If you are under 18, you must have permission from a parent or legal guardian to make in-app purchases.

3. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial entertainment. You may not:

• Copy, modify, or distribute the App or its content
• Reverse engineer, decompile, or attempt to extract source code
• Use cheats, exploits, automation, or unauthorized third-party tools
• Sell, trade, or transfer your account or virtual goods for real money
• Interfere with the App's servers or other players' experience

4. Accounts & Progress

The App creates an anonymous account automatically on first launch. You are not required to register with your name or email address.

We may provide a recovery code to help restore progress if you lose access to your device. You are responsible for storing this code securely. We cannot restore progress without it if your local data is lost.

Accounts and progress are non-transferable. You may not sell, share, or give your account to another person.

5. Virtual Goods & Currencies

The App includes virtual currencies and items such as Gold, Driftwood, Deep Iron, Black Pearls, ships, relics, coffers, and charter access ("Virtual Goods").

• Virtual Goods have no real-world monetary value
• Virtual Goods are licensed to you, not sold
• Virtual Goods cannot be exchanged for real money or transferred outside the App
• We may modify, balance, or remove Virtual Goods as part of game updates
• We are not liable for loss of Virtual Goods due to account termination, game balance changes, or technical issues beyond our reasonable control

6. In-App Purchases & Subscriptions

Purchases

The App offers optional in-app purchases including Black Pearl packs and charter unlocks. All purchases are processed through Google Play (Android) or the Apple App Store (iOS).

Subscriptions

Some charter slots require an active subscription. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions in your device's app store settings.

Refunds

All purchases are final except as required by applicable law or the refund policies of Google Play or the Apple App Store. Refund requests must be submitted directly to the respective store.

7. Rewarded Ads

The App offers voluntary rewarded video ads that may grant in-game benefits such as timer acceleration. By choosing to watch an ad, you acknowledge that:

• Ad availability is not guaranteed and may vary by region and device
• Rewards are granted only after server-side verification of ad completion
• Ad content is provided by third-party advertisers through Google AdMob
• We are not responsible for the content of third-party advertisements

8. Gameplay & Fair Play

Expedition outcomes, loot, and progression are determined by server-authoritative game logic. We reserve the right to:

• Modify game balance, economy, and mechanics in updates
• Suspend or terminate accounts that use cheats, exploits, or unauthorized modifications
• Reverse illegitimate gains obtained through abuse or technical exploits

The core expedition loop is always available to free players. We do not guarantee specific outcomes, drop rates, or progression speeds.

9. Service Availability

We strive to keep the App available but do not guarantee uninterrupted access. The App may be unavailable due to maintenance, updates, network issues, or circumstances beyond our control. We may modify, suspend, or discontinue features or the App entirely with reasonable notice where practicable.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be error-free, secure, or uninterrupted.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Benum Labs AS and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of Virtual Goods, data, or profits, arising from your use of or inability to use the App.

Our total liability for any claim arising from these Terms or the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty Norwegian kroner (NOK 50), whichever is greater.

12. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms or engage in conduct harmful to the App or other players. You may stop using the App at any time by uninstalling it from your device.

Upon termination, your license to use the App ends and you may lose access to your account and Virtual Goods without refund.

13. Governing Law

These Terms are governed by the laws of Norway, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Norway, unless mandatory consumer protection laws in your country require otherwise.

14. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by the "Last updated" date at the top of this page. Continued use of the App after changes constitutes your acceptance of the revised Terms.
